From the article: The Tesla feature known as “Full Self-Driving (Supervised)” does not turn your car into the driver of your car. To some, that may sound like anti-Tesla propaganda, but take it from Tesla itself, which writes in a disclaimer: “Full Self-Driving (Supervised) requires active driver supervision with eyes on the road and does not make the vehicle autonomous. You, and any drivers you authorize, are always responsible for the safe operation of the vehicle when using these features, as well as for any and all speeding, tolls, parking and other traffic violations even when it is in use. It’s your responsibility to make sure that you only use Full Self-Driving (Supervised) when it’s safe and legal to do so.”

The driver is in the drivers' seat and is driving, and is responsible for reducing the speeed to comply with speed limits - either by switching to the lowest speed profile ("Sloth"), or by disengaging FSD and manually slowing down.

I tried the same excuse after I fell asleep at the wheel and ran over an old lady and her dog. 'I swear I wasn't driving. The car just did that all by itself.'
